CRA's tabletop exercise highlighted legal issues surrounding State agency response and decision-making processes in the event of a state of emergency declared by the Governor during an electoral event. Through the use of dynamic scenarios including the effect of tornados on voters in an electoral area, ice storms, and a rail derailment in the DC metropolitan area, specifc issues of concern were examined in an open and dynamic forum. Some of the issues examined included the authority to declare a State of Emergency in the Governor’s absence, the Governor’s succession, and election law issues. The Declaration of Emergency in Governor's Absence included vignettes which highlighted circumstances, situations, or issues identified during the planning process as having legal significance to State agencies. The intent was to note any gaps in statutory authority for possible legislative resolution, successfully generating active discussion among participants.

Dear Mr. Lemer:
I commend the CRA, Inc. team that facilitated the Office of the Attorney General's Third Annual Table Top Legal Exercise on October 20, 2008 in Richmond, Virginia. This event marked the third time that the Office of the Attorney General partnered with the Office of Commonwealth Preparedness, the Virginia Department of Emergency Management, and CRA, Inc. to host a table top exercise focusing on the legal issues that state agencies are likely to face when responding to emergency situations.
The CRA, Inc. team...put in many hours of preparation that included attending initial, interim, and final planning conferences in Richmond and Alexandria, as well as closely coordinating with my staff on the development of the Situation Manual and the Legal Questions for discussion. I was most impressed with the professionalism and thoroughness of the work produced by CRA. The materials were presented in a well-organized manner from the Situation Manuals to the power point slide show. Following the exercise, the CRA team was complimented for providing excellent materials and for facilitating the exercise to allow for the open exchange of ideas and viewpoints.
It was my pleasure to work with such a fine team of professionals. Thank you again for the role CRA played in helping my staff identify legal issues that state agencies may face during a disaster.
